Defiance ETFs has adopted this privacy policy with recognition that protecting the privacy and security of the personal information we obtain about our customers is an important responsibility. We also know that you expect us to provide service to you in an accurate and efficient manner and to be compliant with all applicable laws. To do so, we must collect and maintain certain personal information about you. We want you to know the nature of the information we collect and how we use and safeguard that information.

We collect certain non-public information about you (“Customer Information”). Customer Information we collect may include:

Identifying information such as your name, phone number, email address, and Internet Protocol address;

Your status as a financial planner, if applicable; and

Information about your computer, Internet connection, page interaction information, and page response times that we may obtain through the use of cookies.

When someone visits our website, Defiance ETFs collects the visitor’s IP address. We use IP addresses to help diagnose problems with our server, and to administer our website. IP addresses are also used to gather broad demographic information, such as the number of visitors to our website.

When someone requests additional information from Defiance ETFs, or its affiliates, via online forms, inquiries at trade shows, or direct contact with a company representative, we will ask them for contact information (such as an email and business address and phone number).

We have opted-in to “The LeadLander Contact Network.” LeadLander is a web analytics tool, similar to Google Analytics. However, The LeadLander Contact Network pools together contact information collected through any Defianceetfs.com forms or email campaigns and any other LeadLander opted-in website forms or email campaigns to identify a visitor to the Defianceetfs.com website. Whenever a visitor goes to any LeadLander opted-in website, LeadLander can display the visitor by their name and email address in its reports.

We collect Customer Information for the following reasons:

To contact you regarding certain financial products;

To create aggregated statistical data and other aggregated and/or inferred non-personal information, which we may use to provide and improve our services; and

To comply with applicable laws and regulations.

Amount of Time We Store Your Information:

We may store the Customer Information for up to forty-eight (48) months after our last interaction with you.

Security of Your Information:

We restrict access to your Customer Information to those employees who need to know that information to contact you or to otherwise assist in promoting certain financial products. We maintain physical, electronic and procedural safeguards that comply with applicable federal or state standards to protect your Customer Information. We store your information on servers located in the United States.

Viewing, Modifying, and Deleting Your Information:

We believe your Customer Information belongs to you. If you would like to access, correct, amend, or delete any Customer Information we have related to you, or if you would like us to stop processing your Customer Information, we invite you to contact us at info@defianceetfs.com or 78 SW 7th St. 8th Floor Miami, FL, 33130.

We use and disclose the categories of personal information we collect from and about you consistent with the business purposes discussed in the section “Information We Collect.”

The CCPA also sets forth obligations for businesses that “sell” personal information to third parties.  We do not “sell” personal information and have not sold any personal information in the past 12 months.

If you are a California resident, you may have the following consumer rights under the CCPA:

Certain information may be exempt from requests under applicable law.
